Terms of Service

These terms govern your use of KimatAI (“the Service”), operated by MENTIUS LTD, a company registered in England and Wales (company no. 17122926, registered office: 60 Tottenham Court Road, Area 1/1, Suite 22, Fitzrovia, London, W1T 2EW) (“we”, “us”). By creating an account or using the Service you agree to them.
1. The Service
KimatAI is an AI-assisted travel planning tool: it generates itineraries, suggests destinations, and provides trip management features (bookings notes, packing lists, budgets, maps, exports and a conversational companion).
2. AI-generated content — important
Itineraries and companion answers are generated by AI. They can be wrong, out of date or incomplete — opening hours, prices, transport times and even the existence of venues should be verified before you rely on them. The Service is a planning aid, not a travel agent, booking service or guarantee. You are responsible for your own travel decisions, bookings, documents, insurance and safety.
3. Your account & acceptable use
- You must be at least 16 years old to use the Service.
- You must provide accurate information and keep your credentials secure; you are responsible for activity on your account.
- Don't misuse the Service: no unlawful content, no attempts to break, overload, scrape or reverse-engineer it, no abusing AI features beyond fair personal use, and no infringing others' rights in content you add.
- We may suspend or terminate accounts that breach these terms, with notice where reasonable.
4. Your content
You own the content you create. You grant us the licence needed to store, process and display it in order to run the Service (including sending relevant parts to our AI provider to generate responses). Trips you share via link or member invites are visible to those recipients.
5. Plans & payments
The free plan includes a limited number of AI itinerary generations and a daily AI-actions allowance. We offer two paid options, both handled by Stripe:
- Globetrotter Pro — a monthly subscription that renews automatically until cancelled. Cancel anytime via the billing portal; access continues to the end of the paid period.
- Trip Pass — a one-off purchase that adds a set number of itinerary generations (which don't expire) plus a temporary boost to your daily AI allowance. It is not a subscription and does not renew.
Prices may change with at least 30 days' notice; changes never affect a Trip Pass you've already bought.
6. Cancellation & refunds
As digital content supplied immediately, the Service is provided as soon as you start using it. Where you have a statutory 14-day right to cancel (UK/EU consumers), you agree that by using the AI features straight away you ask us to begin immediately and acknowledge you lose that cancellation right once the service has been fully performed. This does not affect your other statutory rights — including a refund if the Service is faulty or not as described. You can cancel a Globetrotter Prosubscription anytime; we don't generally refund part-months, but we'll always honour your legal rights and are happy to sort out genuine problems — just email us.
7. Availability & changes
We aim for high availability but the Service is provided “as is” without warranties of uninterrupted or error-free operation. We may add, change or withdraw features. We depend on third-party providers (including Google, Stripe, OpenWeather, Vercel, MapTiler, Wikimedia and Brevo) whose outages can affect the Service.
8. Closing your account
You can stop using the Service and delete your account and its data at any time from Account → Delete account. We may suspend or close accounts that breach these terms, with notice where reasonable.
9. Changes to these terms
We may update these terms from time to time. We'll post the new version here and update the date above; material changes will be flagged in the app. Continuing to use the Service after a change means you accept the updated terms.
10. Liability
Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses — including losses arising from travel decisions made on the basis of AI-generated content.
11. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts (consumers keep any mandatory protections of their home country).
